【在110學年度的第3學期,本課程主題以健康醫療產業為範圍,個案研究亦以相關案例為本。】健康醫療產業自古有之,晚進則急速成長並擴張,由國民至移民人員幾乎人人參與,個個受用。本產業的職場是極易產生法律爭議的場合,其高階主管與從業和醫護人員也經常要面對許多倫理上的挑戰,更有面對競爭與效率的決策情境;健康醫護人員除了要熟悉專業相關的規定,了解自己的義務與責任,並懂得權利以保護自己之外,也要建立工作的倫理規範,並對較具爭議的營運與決策應有正確的解決方案。各週主題,從一般因應需求到積極主動發展,包括有:
01 健康產業的特徵-倫理-法律-專業 02 健康產業的建構與國際發展走向
03 醫療臨床倫理概論 04 交易契約的專業與倫理
05 醫務合作交易 06 委託經營交易
07 組織併購的法律與倫理 08 健康產業人員的勞動契約
09 養生管理與法律糾紛 10 醫療糾紛(民刑事責任)的處理與預防
11 科技與倫理:器官捐贈與移植的法律爭議 12 科技與倫理:人工醫療(人工流產、生殖與其他)的法律爭議
13 科技與倫理:安寧緩和醫療條例 14 回顧與展望
*個案研究:台灣健康醫療產業相關司法裁判,2016-2022;本期上課引用案例,以近6年來「重大健康醫療爭議與決策管理」為主軸,範圍開放有兩層次:(1)產業主題不侷限於醫療:而含括健康與養護等企業;(2)倫理與法律不聚焦於刑事責任討論:而延伸至交易、勞動與民商活動,包含契約與組織等經營,在實務上涉及倫理-法律-專業的處理與預防。

課程目標 Objectives

         The subject provides a strong overview of the global marketplace in which governments interact with international corporations, and the seminars present up-to-date analysis of recent changes in governmental regulation of business.

本課程除闡述基本倫理、效率和法律概念外,更著重案例演變分析的環境因素,以便提供學習者完整的健康醫療專業的脈絡資訊。【註:本學期(暑修)授課範圍聚焦於健康醫療產業。】
