課程目標 Objectives

近期因為立法院職權行使法的修訂，引發了高度的憲政爭議，間接也帶出了總統角色是否為「憲政守護者」的討論。然而，國家元首作為憲法的守護者，並不單純只是政治口號，而是有著思想史厚度的理論議題，本課程將深入德國法學者施密特和凱爾森的辯論，試圖從這些理論資源反思國家元首所可能具有的憲政角色。

授課方式 Teaching methods

本課程主要以討論的方式進行。參與者需要在課前閱讀指定材料。每週會有參與者對於課程內容進行口頭報告，整理當週閱讀材料的主題與論點，並且提出自己的觀點和批評。藉此培養掌握文本、重構思想、撰寫學術文章等必要的基礎能力。
課程摘要：參與者需要負責依照分配範圍，撰寫書面摘要以及在課堂上進行口頭報告。摘要應包含以下內容：（1）整理作者的主要觀點，並以自己的話語重新表述；（2）以學術引用格式標示出處。繳交時間為每週上課前（週二）18：00。
期中口頭報告：需自行挑選一個與課程相關的議題自行撰寫研究計畫（4-5頁），並在課堂上口頭報告（每人10-15分鐘）。報告內容必須包含四部分：（1）研究動機；（2）所要研究的問題和政治理論重要問題的關連性；（3）既有的文獻和研究成果，與其不足之處；（4）預期的結果。
期末報告：將研究計畫撰寫成為完整的學術論文，需要完全符合學術格式。截止日期為2025年6月5日下午18:00整。
