課程大綱 Course syllabus

         \\140.117.152.55\crs_net_data\crs_outline\1131\outline\IPS710.TXT近期因為立法院職權行使法的修訂,引發了高度的憲政爭議,間接也帶出了總統角色是否為「憲政守護者」的討論。然而,國家元首作為憲法的守護者,並不單純只是政治口號,而是有著思想史厚度的理論議題。

課程目標 Objectives

         本課程將閱讀孟德斯鳩、貢斯當等自由主義思想家的討論,以及德國法學者施密特和凱爾森的辯論,試圖從這些理論資源反思國家元首所可能具有的憲政角色。

授課方式 Teaching methods

         本課程主要以討論的方式進行。參與者需要在課前閱讀指定材料。每週會有參與者對於課程內容進行口頭報告,整理當週閱讀材料的主題與論點,並且提出自己的觀點和批評。藉此培養掌握文本、重構思想、撰寫學術文章等必要的基礎能力。
․課程摘要:參與者需要負責依照分配範圍,撰寫書面摘要以及在課堂上進行口頭報告。摘要應包含以下內容:(1)整理作者的主要觀點,並以自己的話語重新表述;(2)以學術引用格式標示出處。繳交時間為每週上課前(週二)18:00。
․ 期中口頭報告:需自行挑選一個與課程相關的議題自行撰寫研究計畫(4-5頁),並在課堂上口頭報告(每人10-15分鐘)。報告內容必須包含四部分:(1)研究動機;(2)所要研究的問題和政治理論重要問題的關連性;(3)既有的研究成果與其不足之處;(4)預期的結果。
․期末口頭報告:在期中報告的基礎上進行修改,或另外選擇新題目,自行撰寫研究計畫,並在課堂上口頭報告。報告內容和要求同期中報告。
․期末書面報告:將兩次口頭報告的研究計畫撰寫成為完整的學術論文,需要完全符合學術格式。截止日期為2025年1月21日下午18:00整。
