課程大綱 Course syllabus

一、IATTC Antigua公約之發展與內容
二、國際法之主體：國家與政府
三、國際法之淵源

課程目標 Objectives

一、本課程旨在就國際公法之大要內容給予碩士班研究生基礎之訓練，使其能從事更進一步之鑽研或延伸至其他國際公法特殊主題領域（譬如海洋法、太空法、環境法、經貿法、人權法等）之研究。
二、本課程在政治學研究所為選修科目，但在海洋事務研究所的「海洋法律與政策」、「海洋外交與治理」二領域，以及海事所開設之「高階水下文化資產專業學程」、「高階國際漁業管理專業學程」及「水下文化資產微學程」中則為核心/必選/必修之科目，其目的在使學生獲得迅速掌握、理解國際公約、協定等國際文件之實務能力。

授課方式 Teaching methods

一、本課程不同於一般大專院校國際法課程之傳統教學進度，由國際法之概念、國際法之淵源、國際法與國內法之關係、條約、國際法之主體等主題一路講下來，而未能觸及國際法領域中鮮活的條約談判、制定與條約實際內涵。故本課程在國際法的總體內涵中將僅仔細教授「國際法的主體」與「國際法的淵源」兩議題，在此之前，本課程將以美洲熱帶鮪魚委員會（Inter-American Tropical Tuna Commission, IATTC）設立公約之新修正版本（又稱為安地瓜公約Antigua Convention）的內容與談判內幕為講授主題，並由此帶出條約、硬法、軟法、國際法主體、國際法淵源等主題，讓學生產生較佳之臨場感及實務感，而不再會覺得國際法與吾人生活經驗與理解是如此的遙遠。
二、本學期中，或因任課教授之公務需要，以及配合疫情之最新發展，而必須調整上課時間或方式（例如遠距教學），請大家諒解，並期以合議方式協調補課時間與場地，請大家配合。
三、第一周上課將採Google Meet進行同步遠距課程，已選課學生請於以下連結進入：https://meet.google.com/eru-ujub-mxv。相關課程資訊置於本校海事所網站首頁（https://gima.nsysu.edu.tw/）。非選課學生擬旁聽者，請於前述G-Meet連結登入，並於留言區留下學號姓名，以做為異常處理之參考。

2. Peter Malanczuk, 1997, Akehurst's Modern Introduction to International Law (London: Routledge, Taylor & Francis Books Ltd, 7th revised ed.)中的相關兩章（必備）。
3. 1969年維也納條約法公約。本公約全文可見於http://untreaty.un.org/ilc/texts/instruments/english/conventions/1_1_1969.pdf。中華民國曾簽署，但未及批准。
