隨著現帶網路商業社會的發展,近幾十年來網絡購物已經受到公眾的高度依賴。網上購物帶來的便利為我們節省了大量時間,省去了許多麻煩。
另一方面而言,這種新型購物也引發了一些我們以前從未遇到過這類問題的新問題。例如:當我們與賣家發生網拍糾紛時,我們如何保護自己的權利?我們下一步該做什麼程序?賣家和購物平台應該承擔哪種責任?
傳統的法律已無法成功解決這些爭議。因此,我國政府制定了新法“消費者保護法”,以解決這些問題。除此之外,“中華民國仲裁法”也是解決爭端不可或缺的必要條件。
本課程將不僅通過書籍,並透過日常生活中發生的案例,向大家建立對“中華民國仲裁法”,“消費者保護法”和其他相關法律或法規的基本了解。
透過此課程學生將熟悉這兩種法律,並應用其處理法律糾紛。
With the development of modern Internet commercial society, the online shopping has become highly dependent by public in the recent decades. The convenience which brought by online shopping has saved us a lot of time and got rid off many problems.
On the other hand, this new type of shopping has also caused some new problems which we never confronted with this kind of problems before. For example: How can we protect our right when we have trade dispute with the sellers? What procedure we should do the next? And the last but not the least, which kind of the responsibility should sellers and shopping platform bear in this trade dispute?
Those traditional laws have been unable to deal successfully with these disputes. As the result of this, our government has formulated a new law in modern times which is Consumer Protection Act to solve these problems. In addition to, The Arbitration Law of ROC is also an indispensable essential in the settlement of disputes.
This course will cover a basic understanding of The Arbitration Law of ROC, Consumer Protection Act and other relevant law or regulation to everyone through not only book but the teacher`s commentary of those occur that happened in our daily life.
Through this course, students shall get familiar with these two laws and learn to deal with disputes by using these two laws.


課程目標 Objectives

         本課程將透過書籍,將其內容延展至實務案例中,讓學生不只是學習課本上的知識,而是可讓其靈活運用在日常生活裡。
在實際上的案例中,不只是從學說上的腳步來觀察,甚至是以實務上的處抵方式來解析這個問題,將學說與實務作進一步上的結合,讓學生能夠在面對實際上的狀況時,能有更多元的看法來處理。
In this curriculum, we will not only learn from the book but use those basic knowledges to resolve the problem happened in the case. During this, students shall be more familiar with the law and can use them in some particular situation.
The first thing for resolve the case is to observe the condition of it. We should combinate the Judicial Practices and theory to analysis the case. As the result of this, students are able to see things in a various way.
